Terms of use

This English version is a translation provided for convenience. In case of discrepancy, the French version prevails.

1. Purpose

These terms of use (the “Terms of Use”) set the rules for using SuperMDT (the “Service”), published by [TO COMPLETE: company name] (the “Publisher”), for anyone who signs in (a “User”), whether organization owner, invited member or visitor of a public page of the Service.

Subscriptions taken out by organizations are governed by the terms of sale. The processing of personal data is described in the privacy policy.

2. Acceptance

Users accept the Terms of Use when they first sign in. Users who do not accept them must not use the Service. The Terms of Use may change; the version in force is the one published on this page, and Users are informed of any significant change when they sign in.

3. Access to the Service

3.1. Discord account. Sign-in is exclusively through a Discord account. Users must meet Discord’s age and usage requirements and, if they live in France and are under fifteen (15), have the permission of their legal guardian. Users are responsible for the security of their Discord account.

3.2. Organizations. Each game server has its own organization, administered by its owner and the members they authorize. A User’s access to an organization, their ranks and their permissions are decided by that organization, not by the Publisher. An organization may remove a member’s access at any time.

3.3. Bridge and in-game tablet. Using the Service from the game (tablet, alerts, plate reader…) requires the game server to have installed the SuperMDT bridge. Users must also follow that server’s rules.

4. A service for roleplay

The Service is used to manage the fictional public services of a roleplay game server. The people, records, reports, medical files, complaints and cases entered in it concern fictional characters and events.

Users undertake not to enter any information about real people that is not required for the Service to work: no real name, address, phone number, photograph, real health data or information that identifies a player in real life within game content. The only real identifiers used by the Service are those required for it to work (Discord account, FiveM player identifiers and Rockstar license sent by the bridge).

The Service must never be used as a tool of a real public service, nor to prepare or document real events.

5. User content

5.1. Responsibility. Each User is responsible for the content they enter or send (text, photos, files, messages). The organization that invited them is responsible for how the Service is used within it and for moderating its members.

5.2. Rights. Users warrant that they hold the rights to the content they send, in particular photos and documents. They grant the Publisher the non-exclusive right to host, reproduce and display it solely to the extent necessary for the Service to work and for as long as it is kept. Content belongs to its authors and to the organization, not to the Publisher.

5.3. Retention. Content deleted in the Service goes to the organization’s archives, from which it can be restored, until it is purged by the organization’s owner. Sensitive actions are recorded in the organization’s audit log.

6. Prohibited conduct

In or through the Service, it is prohibited to:

• publish illegal content, in particular: incitement to hatred or violence, glorification of terrorism or crimes against humanity, harassment, threats, defamation or insults targeting a real person, child sexual abuse material or content sexualizing a minor, content infringing the privacy or image rights of a real person, infringement of intellectual property;
• disclose real personal information about a player or third party (“doxxing”), including from their game or Discord identifiers;
• use player identifiers, in-game positions or logs for any purpose other than managing the organization’s roleplay;
• attempt to access another organization’s data, bypass the Service’s permissions, limits or security, or test its vulnerabilities without the Publisher’s written consent;
• disrupt the Service (deliberate overload, massive automated sending, malware), or extract its data by automated means other than the exports and integrations provided;
• tamper with the bridge, its keys or the data it sends, or impersonate another User;
• resell or give access to the Service outside the organization that subscribed to it.

Violent, criminal or dramatic content belonging to the roleplay fiction (investigations, arrests, character injuries…) is of course allowed, within the law and the server’s rules.

7. Reporting and moderation

7.1. Moderation by the organization. Each organization first moderates its own content and members, using the Service’s tools (archives, permissions, access removal, audit log).

7.2. Reporting content. Anyone can report to the Publisher content they believe is illegal, at [TO COMPLETE: reporting email address], stating the exact address or location of the content, why they believe it is illegal, and their name and email address (except for child sexual abuse material, which can be reported anonymously). The Publisher acknowledges receipt and handles the report diligently and objectively. Manifestly illegal content can also be reported to the authorities, for example on the French PHAROS platform.

7.3. Measures. Where content is illegal or breaches the Terms of Use, the Publisher may, proportionately: make it inaccessible, remove it, suspend a User’s access or, in serious or repeated cases, an organization’s. Unless the law provides otherwise or an investigation would be put at risk, the User or organization concerned receives a statement of reasons setting out the facts, the grounds and the available redress.

7.4. Appeals. Anyone affected by a moderation decision, or who reported content, may contest it by replying to the decision message or writing to [TO COMPLETE: email address], within six (6) months. Appeals are reviewed by a person, not solely by automated means. Recourse to the courts always remains possible.

7.5. No general monitoring. The Publisher does not generally monitor content. It acts on reports or when it becomes aware of manifestly illegal content.

7.6. Point of contact. The Publisher’s single point of contact for authorities and Users, within the meaning of articles 11 and 12 of Regulation (EU) 2022/2065 on digital services, is reachable at [TO COMPLETE: point of contact email address], in French or English.

8. Availability

The Publisher strives to keep the Service available but does not guarantee uninterrupted availability. The Service may be interrupted for maintenance or in case of incident. An organization whose subscription has ended or is unpaid may become read-only and then be archived, as provided in the terms of sale.

9. Intellectual property

The Service, its software, brand, logo and documentation belong to the Publisher. The Terms of Use only grant Users a personal right to use the Service within their organization.

10. Liability

Users use the Service under their own responsibility. The Publisher is not liable for content entered by Users or sent by game servers, for decisions taken by an organization (ranks, sanctions, access removals), or for third-party services (Discord, FiveM, server scripts). Nothing in the Terms of Use limits the rights consumers have under the law.

11. Account suspension

In case of breach of the Terms of Use, the Publisher may suspend or block a User’s access to the Service, proportionately, after a warning except in urgent cases, with a statement of reasons (section 7.3). Users may stop using the Service at any time and request deletion of their account as described in the privacy policy.

12. Governing law

The Terms of Use are governed by French law. The French version prevails. Disputes fall under the courts with jurisdiction under the law; consumers may use the mediation provided in the terms of sale.
